Terms of Service
Last updated: 27 September 2026
These terms govern your use of Diviners Lead Gen (the “Service”), a B2B lead-generation and outreach tool provided by Diviners Digital (“we”, “us”). By creating an account or using the Service, you agree to these terms. If you are using the Service for an organisation, you confirm you are authorised to accept these terms on its behalf.
1. What the Service does
Diviners Lead Gen helps you find businesses by type and location, discover the contact email published on their website, and send personalised outreach emails from your own connected email address. You control who you contact and what you send.
2. Free trial
New accounts get a one-day free trial with full access. No payment card is required to start the trial. When the trial ends, access is paused until you upgrade to a paid subscription.
3. Subscription and payment
Full access costs US$49.99 per month. Payment is made manually: you contact us to upgrade, we send you secure payment details, and we activate your account within 24 hours of receiving payment.
Because billing is manual, we do not automatically charge you. Your access continues for the period you have paid for; to keep using the Service you renew your payment before it ends. If payment is not received, access is paused until it is.
Prices are in US dollars and may change with reasonable notice. Any change applies to future payments, not the period you have already paid for. Except where required by law, payments already made are non-refundable, though we will always try to resolve genuine problems fairly.
4. Acceptable use
You are responsible for how you use the Service and for every message you send through it. You must:
- Comply with all laws that apply to you and to the people you contact, including anti-spam and data-protection laws such as CAN-SPAM (US), GDPR and PECR (UK/EU), CASL (Canada) and PECA (Pakistan).
- Only contact businesses where you have a lawful reason to do so, and keep your messages relevant and honest.
- Use accurate sender information and a real, working reply address — never disguise or falsify who you are.
- Include the unsubscribe option that the Service provides in your emails, and honour every opt-out promptly. The Service keeps a suppression list; you must not try to bypass it.
- Send at a reasonable volume and pace, using the safe-sending controls we provide.
You must not use the Service to send spam or bulk unsolicited email in breach of law, to harass, deceive, defraud or threaten anyone, to send illegal, hateful or adult content, to contact people who have opted out, to collect or message consumers’ personal data unlawfully, or to break the terms of your email provider. Misuse can cause real harm and legal liability — it is strictly prohibited.
5. Your responsibilities
You are solely responsible for your campaigns, your content, your lists and your compliance with the law in every country where your recipients are located. You keep your login details secure and are responsible for activity on your account. You connect your own sending email and are responsible for its reputation and for any limits your email provider sets.
6. Our role and what we don’t promise
We provide the tool; we do not write your strategy, choose your recipients or send on our own behalf. We do not guarantee any particular number of leads, replies, sales, deliverability or inbox placement — results depend on your targeting, your message and factors outside our control.
The Service is provided “as is”. We work to keep it available and accurate but cannot promise it will always be uninterrupted or error-free, and business data found online may sometimes be incomplete or out of date.
7. Data protection
Our Privacy Policy explains what personal data we handle and how. For the business contacts you discover and the outreach you run, you act as the data controller and we act as your processor, handling that data on your instructions to provide the Service.
8. Suspension and termination
You can stop using the Service at any time. We may suspend or close an account that breaches these terms, is used unlawfully, generates serious spam complaints, or puts other users or our providers at risk — where practical we will warn you first, but we may act immediately for serious or repeated misuse.
9. Intellectual property
The Service, its software, design and branding belong to Diviners Digital. You may use it only as allowed by these terms. Your data, lists and message content remain yours.
10. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect or consequential losses, lost profits, lost business or damage to reputation, or for claims arising from how you use the Service or from messages you send. Nothing in these terms limits liability that cannot be limited by law.
11. Changes
We may update the Service and these terms from time to time. We will post the new version here with an updated date, and significant changes will be notified where reasonable. Continuing to use the Service means you accept the updated terms.
12. Governing law
These terms are governed by the laws of Pakistan, and the courts of Faisalabad have jurisdiction, unless mandatory law in your country says otherwise. (If you would prefer a different governing law, tell us and we can agree it in writing.)
